The commercial real estate market is a much different arena than it was a year ago. Buyers turn a more critical eye to valuation issues and face capital shortages; sellers, watching their equity cushions decrease (or disappear), strive to obtain top dollar for their investments; and lenders take a more cautious approach to underwriting. These are difficult times to get deals done. Now, more than ever, buyers and sellers need a team of advisors to ensure that a deal worth doing actually crosses the finish line.
This year’s commercial real estate program focuses on the practical realities of completing a real estate transaction in a radically different market. Participants will learn how to: evaluate a real estate project in light of other investment alternatives; form a purchasing group to accumulate equity in a tight market; conduct a thoughtful due diligence investigation; work with lenders to obtain reasonable financing terms in a scarce credit environment; and deal competently and ethically with distressed properties. Participants will also gather practical tips and insights as our panelists engage in a mock negotiation regarding a “challenging” property.

Ned M. Barnes, Program Co-Chair, is a senior partner at Witherspoon Kelley Davenport & Toole PS. He practices primarily in the fields of banking, corporate, and real estate law. He is currently a Fellow in the American College of Real Estate Lawyers and is listed in The Best Lawyers in America.
Paul M. Davis, Program Co-Chair, is a principal at Lukins & Annis PS where he focuses his practice on commercial leases,
purchase and sale, loan documentation, easements and restrictive
covenants as well as real estate financing and corporate and
securities law.
Scot D. Auble, MAI, is President and Principal at Auble Jolicoeur & Gentry. He has extensive experience in appraisal
analysis and reporting focusing on subdivisions, feasibility

David L. Peden, PE, SE, a Principal and Structural Engineer at Coffman Engineers, Inc., focuses on commercial or
institutional building projects requiring structural engineering or
multi-discipline engineering, seismic design or seismic upgrades
of existing structures, feasibility studies, value engineering and
constructability reviews.
Mark Pinch, an Associate with NAI Black, serves users and investors in acquisition and disposition; tenant representation; property, asset and facilities management. He holds a BA in Accounting, Economics, and Business from Western Washington University and a Certified Public Accounting Certificate from Eastern Washington University Graduate School.
William H. Reetz, Jr is the Washington State Counsel for
